1. Agreement to Terms
By accessing or using GainTrax ("the Service"), operated by GainTrax ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
GainTrax is a fitness platform that provides workout tracking, nutrition logging, habit tracking, wearable device integrations, AI-powered coaching, and trainer-client management tools. The Service is available via web application and mobile applications.
3. Account Registration
To use the Service, you must create an account by providing a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete registration information
- Notifying us immediately of any unauthorized use of your account
You must be at least 16 years old to create an account and use the Service.
4. Subscription Plans and Billing
4.1 Free and Paid Plans
GainTrax offers a free tier with limited features and paid subscription plans (Basic, Pro, and Elite) with additional capabilities. Feature availability for each tier is described on our pricing page.
4.2 Billing
Paid subscriptions are billed monthly through Stripe, our payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
4.3 Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free tier.
4.4 Refunds
Subscription fees are generally non-refundable. However, if you experience a billing error or technical issue that prevented you from using the Service, please contact us and we will review your case.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious content, viruses, or harmful code
- Use automated tools (bots, scrapers) to access the Service without our written consent
- Resell, redistribute, or sublicense the Service without authorization
- Impersonate another person or entity
- Use the AI coaching features to generate harmful or misleading health advice
6. AI-Powered Features
GainTrax uses artificial intelligence to generate workout plans, meal plans, nutrition estimates, and coaching responses. These AI-generated outputs are for informational and educational purposes only. They do not constitute medical, nutritional, or professional fitness advice.
You should consult a qualified healthcare provider or certified fitness professional before beginning any new exercise or nutrition program, especially if you have any pre-existing health conditions.
7. Trainer Portal
If you use the trainer features, you are responsible for maintaining appropriate professional relationships with your clients. GainTrax is a tool to facilitate trainer-client communication and does not verify trainer certifications or qualifications.
8. User Content
You retain ownership of all data you submit to the Service, including workout logs, nutrition entries, and profile information. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.
We do not sell your personal data to third parties. See our Privacy Policy for details on how we handle your data.
9. Wearable Integrations
The Service may integrate with third-party wearable devices and platforms (e.g., Apple HealthKit, Google Health Connect, Fitbit, Oura Ring). These integrations are subject to the respective third-party terms and privacy policies. We are not responsible for the accuracy or availability of data from third-party devices.
10. Account Deletion
You may delete your account at any time from the Account settings page. Upon deletion, all your personal data, workout logs, nutrition entries, and other associated data will be permanently removed from our systems. This action is irreversible.
11. Limitation of Liability
To the maximum extent permitted by law, GainTrax and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to fitness results, health outcomes, or uninterrupted access.
12. Disclaimer
GainTrax is not a medical or healthcare provider. The Service does not diagnose, treat, cure, or prevent any disease or medical condition. Always seek the advice of a physician or other qualified health provider with any questions regarding a medical condition.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time. If we make material changes, we will notify you via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
14. Termination
We may suspend or terminate your account at our discretion if you violate these terms or engage in conduct that we determine is harmful to the Service, other users, or our business. Upon termination, your right to use the Service will immediately cease.
15. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
